Service Agreement & Refund Terms
These Terms & Conditions ("Terms") govern your access to and use of the Onty Hosting website, client area, and services ("Services"). By creating an account, placing an order, or using any Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our Services.
1. Changes to Terms
Onty Hosting may update these Terms at any time. The most current version published on our website is the version that applies. Continued use of the Services after updates constitutes acceptance of the revised Terms.
2. Account Registration & Accuracy
You are responsible for providing accurate and complete registration and billing information, including your legal name (or company name), email address, phone number, and address. Certain account details may not be changeable for security and fraud prevention purposes. You are solely responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account.
3. Identity Verification (KYC) & Fraud Prevention
To protect our infrastructure and customers, Onty Hosting may request identity verification and/or additional documentation to confirm ownership of the payment method and account. If verification is not provided when requested, we may suspend or cancel Services and refuse future orders.
4. Acceptable Use & Prohibited Activities
You agree not to use the Services for illegal, abusive, or harmful activities. Prohibited usage includes, but is not limited to:
If abuse is detected, Onty Hosting may take immediate action including rate-limiting, isolation, suspension, or termination without notice to protect the network and other customers.
5. Fair Use of Resources
Shared hosting and virtual services operate under fair use to ensure stable performance for all customers. Continuous resource saturation (CPU, RAM, disk I/O, network) that negatively impacts other users may result in limitations, service throttling, or suspension. If you require dedicated resources, you should upgrade to an appropriate plan.
6. Backups & Data Responsibility
You are responsible for maintaining your own backups unless you have purchased a backup add-on explicitly. Any backups provided by Onty Hosting are provided on a best-effort basis and are not guaranteed to be available at all times. We are not responsible for data loss caused by user actions, software misconfiguration, third-party applications, security incidents, or force majeure events.
Snapshots (if available) are not a substitute for full backups. Snapshots may be deleted when a service is reset, reinstalled, terminated, or otherwise removed.
7. Billing, Payments & Non-Payment
Services are billed in advance according to the selected billing cycle. You must pay invoices by the due date. If payment is not received on time, Onty Hosting may suspend or terminate the Service, and data may be permanently removed after the suspension/termination period. We are not responsible for any data loss resulting from late payment.
8. Pricing & Currency Changes
Prices may change due to operational costs, supplier pricing, currency fluctuations, or market conditions. New orders are charged at the current price at the time of purchase. For existing services, price changes (if any) will apply starting from the next renewal cycle unless otherwise stated.
9. Service Availability (Uptime)
Onty Hosting aims to provide high availability and stable network connectivity. Any stated uptime values apply to network availability only, unless otherwise specified. Scheduled maintenance, emergency maintenance, force majeure, third-party outages, and customer-caused incidents may not be included in uptime calculations.
10. Support Scope
Standard support includes service-related assistance and basic guidance. Advanced administration tasks such as complex troubleshooting, custom configuration, application debugging, and unmanaged system administration may be out of scope and can be offered as a paid service depending on workload and availability.
11. Domains, Licenses & Third-Party Services
Domain registrations, renewals, and transfers are subject to registry/registrar rules and are generally non-refundable once processed. Third-party products such as licenses, SSL certificates, and external services may be non-refundable and governed by their respective providers’ policies.
12. Termination & Suspension
Onty Hosting may suspend or terminate Services without liability if you violate these Terms, engage in abuse, provide false information, attempt fraud, or create risk to the network and other customers. You may terminate your Service via the client area subject to billing and refund rules described below.
13. Refund Policy
Refund eligibility depends on the product type and reason for cancellation. Unless otherwise stated in the product page:
All refund requests must be submitted via the support system. Refunds, if approved, are processed within a reasonable timeframe.
14. Content Complaints & Abuse Reporting
If Onty Hosting receives a credible complaint regarding illegal content, copyright infringement, or abuse, we may request remediation, suspend the Service, or terminate it depending on severity and risk. You are responsible for all content hosted under your account.
15. Intellectual Property
You may not use Onty Hosting branding, trademarks, or copyrighted materials without permission. We may act on valid trademark/copyright complaints as required by law or to protect rights holders.
16. Limitation of Liability
To the maximum extent permitted by law, Onty Hosting shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business, or goodwill. Our total liability shall not exceed the amount paid for the affected Service during the billing period in which the issue occurred.
